General Terms and Conditions of Sale

This document regulates the terms and conditions of sale of the products offered on the e-commerce site managed by Biscottificio Domenico Mascolo S.r.l. Unipersonale, with registered office at Via Marianna Spagnuolo 123, 80054 Gragnano (NA), VAT number/Tax code 07625691212, certified email address: biscottificiodomenicomascolo@legalmail.it (hereinafter “Seller”).

By placing an order, you agree to these Terms in full.

1. Object

The sale includes baked goods, packaged and shipped directly from the manufacturer. Product images are for illustrative purposes only and may differ slightly from actual product appearance.

2. Customers

The site is intended for consumer customers (adult individuals) and, where applicable, also for professional customers.

3. Prices and availability

All prices are in euros and include VAT. Shipping costs are shown separately in the cart before checkout.

The Seller reserves the right to change prices at any time, without prejudice to the price applied at the time of the order.

4. Orders

Placing an order constitutes a contractual offer. Acceptance occurs when an automatic order confirmation is sent via email.

The Seller may refuse or cancel an order in the following cases:

  • product not available;

  • incomplete or false data;

  • suspicious activity or attempted fraud;

  • non-payment.

5. Food products and responsibilities

All products sold comply with current food regulations. The Seller is not responsible for improper use, incorrect storage, or consumption by individuals with allergies. People with allergies are advised to check the ingredients listed on the label.

6. Payments

Accepted payment methods are listed in the “Payments” section. Sensitive data is not managed or stored by the Seller but by certified external providers (e.g., Stripe, PayPal).

7. Shipping and delivery

Products are shipped to the address provided when ordering. Average delivery time is 2-5 business days from shipment. Deliveries cannot be guaranteed on holidays or weekends.

The Seller is not responsible for any delays due to force majeure or courier failures.

8. Right of withdrawal

The right of withdrawal pursuant to Article 59 of the Consumer Code is not provided for, as these are perishable goods.

9. Damaged or incorrect products

Eventuali segnalazioni relative a prodotti danneggiati, errati o difettosi devono essere inviate entro 24 ore dalla ricezione, corredate da foto, scrivendo a:

The Seller reserves the right to evaluate the suitability of the complaint on a case-by-case basis and propose a replacement or refund.

10. Competent court

Any disputes will be subject to the jurisdiction of the court of the consumer’s place of residence or domicile. For professional customers, the competent court is Torre Annunziata.

11. Applicable law

The contract is governed by Italian law, in particular by the Consumer Code (Legislative Decree 206/2005) and Legislative Decree 70/2003 on electronic commerce.

12. Updates

Mascolo reserves the right to modify these Terms at any time. Changes apply to orders placed after the date of publication.
